Why State Governors Cannot Order Citizens to Wear Masks

Mainstream news sources say that California Governor Newsom issued an order requiring everyone to wear face masks in public. Peggy Hall explains that governors have no authority to order citizens to do anything. Their power is limited to directing the agencies for which they are responsible and nothing more. Public-Health agencies are among these and, although they can issue orders of this kind, they can do so only during a time of emergency. An emergency is defined as a health threat with a casualty rate significantly greater than normally present. Since the COVID-19 casualty rate now is officially recognized as not significantly greater than seasonal flu, there is no emergency. Therefore, the California Public-Health Agency has no authority to order anyone to wear masks, remain six-feet apart, shelter-in-place, wash hands, or anything else. Peggy shows were to document these facts and she concludes that it’s time to stop being fearful and just say NO to tyranny. In my state of Texas, masks have never been ordered by the governor and only a few establishments, like Costco, are mandating them. Despite all the evidence of the benign nature of this virus and the ability to heal quickly if contracted, combined with the evidence of the futility of mask wearing, it’s negative side effects, the lack of any science that supports social distancing or sheltering in place, it’s amazing to me how many terrified people there are – people who are demanding that mask wearing be mandatory, that all people are obligated to protect the less than 1%… Read more »

Actually it depends on what emergency powers the state legislature has given the governor. In Minnesota, the legislature had given the governor power to issue orders under emergencies. Of course, it has come back to bite them because the governor has used it to stretch the meaning of emergency to the current ‘crisis’. So he gets to play god like all good democrats like to do. You can’t let a good crisis go to waste you know.

It goes much deeper than this. *ALL* government (Federal, State, County, Municipal/City) is currently incorporated, and thus they have become “de facto” vs. “de jure” governments. All of their statutes, regulations and executive orders ARE NOT LAW, but are simply corporate edicts applying ONLY to the corporations. See US Supreme Court.

I live in a small town about (12,000) here. NO one wore a mask at the very beginning of the PLANDEMIC. NOW (4) months in with cases and deaths at ZERO it’s SUDDENLY mandatory to wear masks? It’s REDONCULOUS!!^_^LOL

I don’t have a problem wearing a mask in a medical office, but I do have issues with wearing them every time I want to go shopping. I tried to wear one this morning at our local Safeway, and after 5 minutes I had to take it off. I felt like I was being suffocated. When you are claustrophobic and have asthma it doesn’t feel good.
