Newsom Repeals California Law that ‘Censored’ Doctors Giving COVID Care

California Governor Gavin Newsom repealed a Democrat-backed law to stop doctors and other medical professionals from spreading “disinformation” about the COVID virus and the effectiveness of COVID vaccines, under threat of revoking their licenses. Doctors were essentially prevented from giving their patients information and advice that was outside of the official narrative, especially regarding the danger of the COVID injections. A lawyer representing doctors said that California repealed the unconstitutional law rather than suffer further humiliation in federal court. The law firm said that the law violated the doctors’ First Amendment rights to free speech and their 14th Amendment rights to due process of law.

California Gov. Gavin Newsom signed a bill to repeal a Democrat-backed initiative that guided how medical professionals could talk about the coronavirus to avoid what one critic called “humiliation” in court.

California Assembly Bill (AB) 2098, passed in September 2022, authorized the revocation of the licenses of any medical professional if they “disseminate misinformation or disinformation related to COVID-19, including false or misleading information regarding the nature and risks of the virus, its prevention and treatment; and the development, safety, and effectiveness of COVID-19 vaccines.”

A group of doctors, represented by the New Civil Liberties Alliance (NCLA), sued Newsom and the state in court, leading to a judge imposing a preliminary injunction in the case.

NCLA says Newsom and Democrats saw “the writing on the wall,” and moved to repeal the law.

“Governor Newsom and the state legislature saw the writing on the wall after Judge Shubb’s grant of a preliminary injunction in January,” said Jenin Younes, counsel at NCLA.

“Rather than suffer further humiliation in federal court, and implicitly conceding the unconstitutionality of AB 2098, the State of California has taken the unusual step of repealing a law that hasn’t even been in effect for a year,” said Younes, calling the repeal “a significant victory.”

Greg Dolin, a senior litigator at NCLA, said it was “sad that it took a full year and a federal court ruling to reaffirm a 250-year-old fundamental truth — in this country, ‘no official, high or petty, can prescribe what shall be orthodox in… matters of opinion or force citizens to confess by word or act their faith therein.'”

NCLA said that the law violated the doctors’ First Amendment rights to free speech and their 14th Amendment rights to due process of law.

“It interfered with the ability of doctors and their patients to freely communicate, serving as a weapon to intimidate and punish doctors who dissented from mainstream views,” the group said.

According to NCLA, physicians and individuals on social media threatened several of the group’s clients with using AB 2098 to take their licenses away, which they claimed was evidence that the law’s insidious intent was always to silence doctors who depart from state orthodoxy on COVID-19.

Newsom has been the subject of criticism from both sides of the aisle for his handling of the pandemic, which mounted to an unsuccessful bid to have him recalled.

Newsom, while imposing strict social distancing and mask mandates statewide, was on multiple occasions caught violating his own rules. In 2020, he was spotted at the French Laundry restaurant in Napa Valley socializing with a large group of people from outside his household while not wearing a mask.

California Governor Gavin Newsom Commuted the Sentences of 21 Violent Criminals, Including Four Murderers

Far-left California Governor Gavin Newsom commuted sentences of 21 violent criminals including four murderers with life sentences without possibility of parole. He says he based his decision on the circumstances of the crime and the sentence imposed, the applicant’s conduct while in prison, and the offenders’ efforts toward rehabilitation. Newsom’s commutations can be rejected or upheld by the California Supreme Court. Kimberly Guilfoyle, a former prosecutor, Fox News commentator, and the ex-wife of Newsom, said that the Governor’s action created a threat to public safety, and was a slap in the face to victims, their families, and law enforcement who put them away. -GEG

Far-left California Governor Gavin Newsom commuted sentences of 21 violent criminals including 4 murderers with life sentences without possibility of parole.

 

One of the murderers was arrested in 1993 for fatally shooting a man during a carjacking and another was incarcerated in 1991 for killing an armed guard during a robbery.

A man who served 31 years of 2 life sentences for a double murder in 1988 was also given clemency by Newsom.

Gov. Gavin Newsom is commuting the sentences of 21 violent offenders incarcerated in California prisons, including four men who have convictions related to homicides in Sacramento County, the governor’s office announced Friday.

Jacoby Felix, Crystal Jones, Andrew Crater and Luis Alberto Velez were convicted of separate murders in the 1990s. All four, now granted commutations by Newsom, were convicted in Sacramento County and sentenced to life in prison without the possibility of parole.

The clemency action was announced Friday in a statement from the governor’s office, which describes the crimes committed by those four men and 17 other state prisoners, and explains the reasoning for commuting their sentences.

“The Governor carefully reviewed each application and considered a number of factors, including the circumstances of the crime and the sentence imposed, the applicant’s conduct while in prison and the applicant’s self-development efforts since the offense, including whether they have made use of available rehabilitative programs and addressed treatment needs,” a statement from Newsom’s office said.

Newsom’s commutations can be rejected or upheld by the California Supreme Court. Recall, the California Supreme Court rejected 10 clemency actions by the state’s former Gov. Jerry Brown.

Newsom’s ex-wife Kimberly Guilfoyle blasted him for releasing murderers with life sentences, calling his move a “threat to public safety.”

California Governor Gavin Newsom Offers Medical Care Benefits to Illegal Aliens



Far-left Governor Gavin Newsom is signing a proposed $213.5 billion budget that includes extending eligibility to California’s Medicaid program low-income illegal immigrants between the ages of 19 and 25. The program will cost an estimated $98 million per year to cover about 90,000 young illegal aliens. Democrats in the state plan to pay for the handouts by taxing those who do not have health insurance, similar to Obamacare’s individual mandate penalty. The program may allow elderly illegal aliens to join in the future.

Democrat state lawmakers in progressive California have agreed to a plan that would extend health benefits to qualifying illegal immigrants residing in the state.

The legislature has a June 15 deadline and is expected to approve the deal in the coming days. It essentially extends eligibility to California’s Medicaid program to young low-income illegal immigrants between the ages of 19 and 25. The move is part of a broader budget plan, which clocks in around $213 billion.

Expanding California’s Medicaid program to low-income illegals would
cost the state about $98 million per year. According to the Associated
Press, roughly 90,000 will qualify.

“California believes that health is a fundamental right,” State Sen. Holly Mitchell (D) said, according to the news outlet.

A number of Democrat state lawmakers wanted to take it a step
further, offering coverage for all illegals in the state, but Democrat
Gov. Gavin Newsom rejected the proposal, citing rising costs.

The agreement also includes assistance for middle-income families. A
family of four making $150,000 could qualify for a $100 a month subsidy
from the government to help cover the cost of their insurance premium.

Democrats in the state plan to pay for the handouts, in part, by
taxing those who do not have health insurance. This is, in essence,
another version of Obamacare’s individual mandate penalty, which the
Supreme Court upheld as a tax in a critical ruling in 2012. However, it
has remained
a point of contention in lower courts. Republicans in Congress worked
with President Trump to scrap what they deemed to be the
unconstitutional penalty in 2017.

California lawmakers say these moves are all part of the state’s
wide-ranging effort to get everyone in the state – including those
residing there unlawfully – covered. This comes at the time of a severe
homelessness crisis in the state, particularly in Los Angeles County.

California Governor Gavin Newsom Scraps High-Speed Train Because It Is Too Expensive


Governor Newsom announced in his ‘State of the State’ address that the plan to connect San Francisco to Los Angeles by high-speed rail “would cost too much and, respectfully, would take too long,” he told legislators. The price of the train rose from an initial estimate of $37 billion in 2008 to nearly $100 billion according to an estimate last year, and the earliest it would have been finished is in 2033.  He said the state would still build a portion of the system under construction in the rural Central Valley, denying that it would be a “train to nowhere.” He said the state would not send $3.5 billion back to the federal government to be spent by President Donald Trump.  The new governor also devoted much of his speech to attacking President Trump over “fear-mongering” over a “so-called border crisis.”

California Governor Gavin Newsom’s first act in office was to propose extending state healthcare benefits to more illegal aliens.

On Tuesday, shortly after being sworn in, Newsom — who ran on the proposal of providing healthcare to everyone in California, though he struggled to explain how he would pay for it — signed an executive order taking steps in that direction.

In his first executive order, Newsom directed the state to create a single government purchaser for prescription drugs to increase negotiating leverage with pharmaceutical companies. Alongside the order, Newsom proposed extending Medi-Cal — the state’s version of Medicaid — to illegal aliens up to the age of 26, rather than 19.

The governor’s forthcoming budget, his office said, “will make California the first state in the nation to cover young undocumented adults through a state Medicaid program.”

That would cover 138,000 “young people in the country illegally,” according to the Associated Press.

“Undocumented young adults should not have to worry about losing their health coverage when they turn 19,” the governor’s office added, saying that the budget proposals, to be presented later this week, would defend Obamacare from “recent federal attacks” and “bring the state closer toward the goal of health care for all.”

In his inaugural address, Newsom promised “sanctuary to all who seek it” — a reference to California’s status as a “sanctuary state” for illegal aliens that refuses to help enforce federal immigration law.

That policy continues to be a lightning rod for national criticism after the murder last month of Corporal Ronil Singh, a legal immigrant and police officer who was allegedly shot and killed by an illegal alien during a traffic stop.

NEWSOM: It needs to be pulled into the governor’s office. The executive needs to lead it. Obamacare would not have happened if it was just exclusively a legislative fiat — that said — and Nancy Pelosi did a magical job of organizing it, but it required the concerted contributions of the president of the United States. The only way in a state whose population that is larger than 163 nations — California — whose economy is larger than all of four nations — fifth largest economy — to approximate a strategy for universal health care with the support and concurrence of the governor. Frankly, that’s not an indictment, it’s just what’s been missing in the past. So, I’d bring that into my office. I brought it well beyond a bill that basically started a process. If you read 562, the vast majority of elected officials that were for and against it didn’t — Did not. For and against did not, because they would have actually known what it said.

It would have created a committee that began a process to come up with a strategy and a plan to finance and organize with 34 prescribed benefits, a universal strategy for single-payer financing. That process can be done without a bill. That process should be done by the next governor and I’m committed to it for no other reason than health care is devouring our budget. Health care in this state is the biggest driver of our unfunded retirement benefits. It’s a driver of a lot of our costs, not the least of which at the UC and CSU. I serve on both those boards. Tuition is impacted by the costs of employment, personnel costs are impacted by health care. It’s the issue that animates most of the voters I talk to, still, even in this post-Obamacare world. The inflationary burdens are self-evident and the vandalism these guys are doing on the federal level is only going to make things worse. I’d like to see if we could control our own destiny. I’m not naive about it. I did universal health care when I was Mayor. Fully implemented, regardless of pre-existing conditions, ability to pay, and regardless of your immigration status. San Franciso is the only universal health care plan for all undocumented residents in America. Very proud of that. We proved it could be done without bankrupting the city. I’d like to see that extended to the rest of the state.
