Republicans Announce New Immigration Reform Plan

Republicans announced the bipartisan ‘Dignity Plan’, which includes protections for Dreamers, the estimated 800,000 DACA recipients who came to the US undocumented as children, as well as a ten-year path for those who lived in the shadows here in the US. The proposal also plans for allowing immigrant non-felons a path to legal status. -GEG

During the same week Democrats in the U.S. House were expected to move ahead with their first effort at immigration reform during the current Congress, Republican lawmakers announced a new plan for reform.

How Judges And Democrats Colluded To Force DACA On Americans Even Though It’s Illegal


The Department of Homeland Security announced this week it will begin accepting applications for the Deferred Action for Childhood Arrivals (DACA) program after a federal judge ordered the Trump administration to reinstate the program earlier this month, despite Obama creating it by fiat, in direct violation of the Constitution’s separation of powers. Programs like DACA, which effectively granted amnesty to hundreds of thousands of illegal immigrants, amount to lawmaking and ought to be passed by lawmakers, not decreed by presidents who can’t get their preferred policies through a divided Congress. And the Supreme Court has allowed it. Democrats under a Biden administration will no doubt seek once again to change immigration law—not by a congressional vote, but by bureaucratic fiat.

The ruling briefly put DACA back in the headlines, with most news outlets framing the judge’s order as a defeat for the departing Trump administration and a victory for Democrats and the “Dreamers.” But the media’s preferred narrative ignores the truth about DACA, an Obama-era program created by bureaucratic fiat in direct violation of the Constitution’s separation of powers.

Democrats and the media like to emphasize all the good DACA has done. They point out that the program’s recipients, mostly young people who were brought to the United States illegally before age 18, have earned degrees, begun careers, paid taxes, married, and had some 200,000 children who are U.S. citizens.

But none of that has anything to do with why President Trump and many Republicans want to end the program. Their purpose is not to punish DACA recipients but to pressure Congress to do its job and reform a dysfunctional and sclerotic immigration system that created this mess in the first place.

The Trump administration’s approach from the beginning was that DACA, however noble its aims, was not legal, and that only an act of Congress—an actual law—could shield certain people from deportation or create a new program authorizing work permits for hundreds of thousands of illegal immigrants, as DACA purported to do.

Trump’s widely criticized efforts to “end” the program were actually meant to prod Congress into action. Recall that in September 2017, the Trump administration announced a plan to phase out DACA, and then deferred the phase-out for six months to give Congress time to come up with a permanent solution.

Lawmakers balked, but Trump gave them another chance during the government shutdown in January 2019, when he proposed a three-year extension of DACA along with an extension of a refugee program in exchange for $5.7 billion in funding for a border wall. The idea, again, was to extend DACA to allow Congress time to devise a permanent solution for DACA recipients, perhaps as part of a broader overhaul of the immigration system. Trump and his top advisors were clear about this at the time.

But congressional Democrats rejected the president’s offer even before it was announced. House Speaker Nancy Pelosi called it a “non-starter” and Senate Minority Leader Chuck Schumer panned it as “hostage taking.”

DACA Isn’t A Law, It’s a Memo

You might think that a president using his executive powers to put pressure on Congress to take legislative action is part of the normal push and pull of our constitutional system. But Democrats seem to think executive branch programs created by Democratic administrations should have the same status as laws passed by Congress.

That is not how it works. Programs like DACA, which effectively granted amnesty to hundreds of thousands of illegal immigrants, amount to lawmaking and ought to be passed by lawmakers, not decreed by presidents who can’t get their preferred policies through a divided Congress.

After all, DACA is not law—not even an executive order. It is a memo. The program was created by the issuance of an executive memorandum in June 2012 from then-Secretary of Homeland Security Janet Napolitano to the heads of U.S. Citizenship and Immigration Services (USCIS), Customs and Border Protection (CBP), and Immigration and Customs Enforcement (ICE). The memo directed these agencies to exercise “prosecutorial discretion” on behalf of anyone who met certain requirements.

That is, under the guise of “discretion,” Obama managed both to ignore existing federal immigration law—thereby betraying his oath of office to “take Care that the Laws be faithfully executed”—and effectively create new law by administrative decree.

Even the language used to talk about the program betrays its unconstitutional origins. Democrats and the media call DACA recipients “Dreamers,” a reference to the DREAM Act, a bill that was first introduced in 2001 but never gained enough support in Congress to pass. What Democrats couldn’t do by law, they eventually managed to do by executive decree.

The Supreme Court Is Partly To Blame Here

So far, the U.S. Supreme Court has let them do it. In June, the court issued a narrowly tailored 5-4 ruling that the Trump administration could not dismantle DACA because DHS’s plan to do so did not comply with the Administrative Procedures Act (APA).

The Supreme Court ruled against President Trump’s plan to end the Deferred Action for Childhood Arrivals (DACA) program created by Obama. The Court ruled that the Trump administration failed to follow the proper procedure to undo DACA. The ruling kicks the can down the road and allows 700,000 ‘Dreamers’ to avoid deportation at this time. Senator Ted Cruz said. “Five Justices ruled today that it was illegal for the Trump Administration to stop breaking the law.” He said the reasoning was that, because the Obama Administration violated federal immigration laws, Trump now has to continue the process.

“We do not decide whether DACA or its rescission are sound policies. ‘The wisdom’ of those decisions ‘is none of our concern,’” Roberts wrote.

“We address only whether the agency complied with the procedural requirement that it provide a reasoned explanation for its action. Here the agency failed to consider the conspicuous issues of whether to retain forbearance and what if anything to do about the hardship to DACA recipients,” Roberts added. “That dual failure raises doubts about whether the agency appreciated the scope of its discretion or exercised that discretion in a reasonable manner.”

It is possible that the Trump administration could make another effort to terminate DACA in a way that complies with the ruling, though Trump faces re-election against presumptive Democratic nominee Joe Biden in November. As a candidate, Trump pledged to terminate DACA “immediately.”

“As President of the United States, I am asking for a legal solution on DACA, not a political one, consistent with the rule of law,” Trump wrote in a post on Twitter Thursday afternoon. “The Supreme Court is not willing to give us one, so now we have to start this process all over again.”

In a dissent joined by fellow conservatives Justices Samuel Alito and Neil Gorsuch, Justice Clarence Thomas wrote that the majority decision “must be recognized for what it is: an effort to avoid a politically controversial but legally correct decision.”

Trump Tweeted that Many DACA Recipients Are ‘Hardened Criminals,’ But He Vowed to Make a Deal with Democrats to Let Them Stay in the US

Mainstream media reported that the Supreme Court seemed likely to shut down the Deferred Action for Childhood Arrivals/ DACA program, the federal scheme that has allowed nearly 800,000 young people, known as “dreamers,” to live and work in the US, protecting them from deportation. However, President Trump tweeted that he would strike a deal with Democrat lawmakers to allow the DACA recipients to stay in the US if the Supreme Court eliminates the Obama-era initiative. His promise to allow the Dreamers to stay goes against his campaign promise to his base in 2016 to deport them. About 8% of the DACA recipients have criminal records.

On Tuesday morning, President Donald Trump signaled a deal with congressional Democrats if the U.S. Supreme Court were to rule in his favor concerning the controversial Obama-era DACA (Deferred Action for Childhood Arrivals) immigration program.

“If Supreme Court remedies with overturn, a deal will be made with Dems for them to stay!” the president said via Twitter regarding DACA.

The Supreme Court will consider the Trump administration’s decision to end the DACA program, which has been argued to have been unconstitutionally enacted by the Obama administration via executive action.

The program defers deportations of immigrants brought over by their parents at a young age.

In the same tweet where Trump signaled a forthcoming deal, he ripped DACA. “Many of the people in DACA, no longer very young, are far from ‘angels,’” he wrote. “Some are very tough, hardened criminals.”

GOP Amnesty Plan Fails After Public Outcry. Trump Pushes Ahead Anyway with Plan to Give 100,000 Foreign Workers ‘Path to Citizenship’ Every Year

Last week, six Republican Senators, including Lindsey Graham, Susan Collins, Thom Tillis, Lamar Alexander, Rob Portman, and Lisa Murkowski, tried to tie funding for the border wall to amnesty for illegal aliens in Obama’s DACA program, but they failed due to public outrage.  New migration from a DACA amnesty would have the potential to allow the entry of nine-million foreign nationals, because every two newly naturalized citizens bring about seven foreign relatives with them. If this were to happen, a border wall could not stop the invasion, because the migrants would arrive legally. No wonder the public was outraged.

It should be noted that, ironically, President Trump did not share this outrage. Instead, he announced his intention to offer “a path to citizenship” to hundreds of thousands of foreign workers who were brought into the US by technology corporations to replace higher-paid American workers. Betrayal? President Trump Has Failed to Deliver the Wall and Now Is Promoting DACA Amnesty

US Commentator, Gary Gileno, argues that President Trump is following the path of most recent presidents by failing to deliver on his important campaign promises. The Koch Brothers Are Spending Millions to Push DACA Amnesty through Congress Before the End of the Year

US: The Koch brothers, who back immigration and cheap labor, are working aggressively to push amnesty for 3.5-million illegal aliens who are enrolled and eligible for President Obama’s Deferred Action for Childhood Arrivals (DACA) program.  In addition to DACA, they also are pushing for prison release and so-called free trade during the lame duck session of Congress before House Democrats are handed the majority in the new year.  The Koch brothers have said they oppose President Trump’s plan to end chain migration that allows newly naturalized citizens are allowed to bring an unlimited number of foreign relatives to the country.  The Koch brothers also support the anchor baby policy of birthright citizenship. -GEG

The pro-mass immigration GOP megadonor billionaire Koch brothers will “work aggressively” before the year’s end to obtain amnesty for the 3.5 million illegal aliens who are enrolled and eligible for President Obama’s Deferred Action for Childhood Arrivals (DACA) program.

The Koch brothers’ network of organizations — which campaigned for Democrats’ open borders policies in the midterm elections — are seeking to ram through their agenda of amnesty, prison release, and more free trade during the lame duck session of Congress before House Democrats are handed the majority in the new year. The year-end agenda is being launched with a multi-million dollar campaign.

A spokesman for the Koch brothers told NBC News:

“We will work aggressively to bring together a divided government to address these critical issues,” said James Davis, a Koch Network spokesman. “It’s a bold, positive vision for what we must do to help people improve their lives.” [Emphasis added]

“We see an opportunity to engage the American people to address some of the toughest problems facing our country: a broken criminal justice system, an immigration system that prevents good people from contributing, eliminating cronyism and promoting open trade,” Davis said. [Emphasis added]

The Koch brothers’ agenda includes securing amnesty for all DACA-enrolled and eligible illegal aliens — a population of about 3.5 million — while also lobbying Congress to pass legislation that would immediately release 4,000 convicts from federal prison.

The prison release legislation has been touted by first daughter and White House adviser Ivanka Trump and her husband, Jared Kushner. The plan, though, is staunchly opposed by conservative leaders who say the legislation would reduce sentences and prison time for hardened drug traffickers.

Months ago, the Koch brothers launched a similar campaign to demand the Republican-controlled Congress pass DACA amnesty. In an ad, the Koch organizations called DACA illegal aliens “patriots” who “work hard” and “put food on the table.”

Currently, the U.S. admits more than 1.5 million legal and illegal immigrants every year, with more than 70 percent coming to the country through the process known as “chain migration,” whereby newly naturalized citizens are allowed to bring an unlimited number of foreign relatives to the country.

Illegal Alien Admits Families Voluntarily Separate From Their Children to Come to America

There were over 700 protests held across the US to oppose Trump’s immigration policy. In Los Angeles, Melody Klingenfuss gave a speech about being left behind as a baby in Guatemala, as her then-teenage mother illegally immigrated to California for economic advantage, and she waited until she was 9 years old to be reunited with her mother.  She admitted that “sometimes family separation begins in the country of origin.”

Protesters in favor of mass immigration and open borders turned out in huge numbers across the country: Chicago had an estimated 60,000 attendees, 55,000 in Los Angeles, 35,000 in Washington, DC, 30,000 in New York and 30,000 in San Francisco.

Demonstrators flooded downtown Los Angeles on Saturday to protest against the Trump administration’s immigration policies.

Thousands of demonstrators, along with a handful of high-profile celebrities, lawmakers, and activists, participated in the Families Belong Together-Freedom for Immigrants March, demanding border agents reunite separated immigrant children from their parents who illegally crossed the Southern border.

Armed with signs that read, “Children are not criminals,” and “compassion has no border,” demonstrators began protesting outside Los Angeles city hall at 11:00 a.m.

Grammy award-winning singer John Legend and his wife Chrissy Teigen participated at the event and urged demonstrators to do more than protest the Trump administration’s immigration policies on social media.

“You can’t just talk about it or tweet about it. You’ve got to do something,” said Legend.

“I know that opening up Twitter right now feels like it can be a horror show, so much of the news is shocking and maddening and depressing,” the singer added. “I think some of us have a strong temptation to just disengage, but we can’t. We can’t do that. I can’t do that. I have to do something.”

The rally featured multiple speeches from activists from open-borders groups, including Coalition for Humane Immigrant Rights of Los Angeles (CHIRLA).

In her address to rally attendees, CHIRLA’s Melody Klingenfuss introduced herself as “undocumented, unapologetic and unafraid.”

“We will not stop until all the families are judged by the content of their character and not the possession of a legal piece of paper,” Klingenfuss said.

The open-borders activist then led the crowd in a chant against the President —”Trump, where’s your heart!?” they shouted.

Leading California lawmakers, including Sen. Kamala Harris, Los Angeles mayor Eric Garcetti and Rep. Maxine Waters fired up the crowd with pro-immigration speeches.

Obama Admin Gave Work Permits to 50,000+ DACA Applicants with Criminal Arrest Records

A new report from the Department of Homeland Security reveals that the Obama administration handed out DACA work-permits and Social Security numbers to more than 50,000 illegal aliens, even though they had arrests records. The criminals who were allowed to remain in the US include 2,503 people with arrest records for battery, 2,378 DUI drivers, 6,629 thieves, and 1,173 burglars.

More than 50,000 illegals got DACA work-permits and Social Security Numbers even though they had an arrest record, says a new report by the Department of Homeland Security.

The DHS factsheet provides some criminal-history details about the 888,765 illegals who asked for work-permits from former President Barack Obama. Those details were hidden by Obama’s deputies, who also hid information about the DACA illegals’ education credentials, eligibility, and work histories.

Many of the arrested DACA people are likely to be grandfathered into the pending amnesty developed by House Speaker Paul Ryan.

The list of 59,786 DACA recipients with arrest records includes 7,814 people who were arrested after getting their DACA status.

Also, 17,079 DACA recipients have been arrested more than two times, says the data.

RINOs and Dems in the House are essentially forcing a vote on mass amnesty.

They’re circulating a petition to do just that, and it’s only seven signatories shy of overriding House Speaker Paul D. Ryan’s (R-Wis.) opposition and forcing votes on a variety of immigration bills to provide a path to citizenship for “dreamers.” It would be the first time the House has passed an immigration bill since Republicans came to power in 2011.

Koch Brothers Push for DACA Amnesty, Threaten Funding of GOP Hold-Outs

The Koch Brothers and their organizations, including Americans for Prosperity, are generally thought to be conservative, but they are advocate for mass immigration and amnesty. Tim Phillips, president of Americans for Prosperity, said that the brothers were disappointed that Obama’s Deferred Action for Childhood Arrivals (DACA) program for amnesty has not yet been passed, and he threatened Republicans with a reduction in campaign donations when he said that the Koch networks will “closely evaluate” their contributions to GOP midterm races. -GEG

The pro-mass immigration GOP megadonor billionaire Koch brothers are threatening Republicans running midterm campaigns, saying they want to see an amnesty for millions of illegal aliens passed or they will “closely evaluate” their aiding and funding of certain candidates.

The Koch brothers represent a number of organizations that purport to be conservative and libertarian-leaning, including Freedom Partners, the LIBRE Initiative, Americans for Prosperity, and Generation Opportunity. The billionaires’ businesses include Matador Cattle Company, Koch Pipeline, and Guardian Industries.

In an interview with The Hill, Americans for Prosperity President Tim Phillips said the pro-amnesty, pro-mass immigration Koch networks would “closely evaluate” their participation in GOP midterm races if those candidates did not help push an amnesty for the millions of illegal aliens who are eligible and enrolled in the President Obama-created Deferred Action for Childhood Arrivals (DACA) program.

Phillips said the Kochs are “disappointed” because the DACA amnesty has yet to pass through the GOP-controlled Congress, despite multiple attempts by the Republican establishment and Democrats. “We’ve been disappointed so far this year and it’s going to cause us to closely evaluate the involvement we may or may not have in individual races,” Phillips says.

Phillips said the Koch networks have told President Trump’s administration and House Speaker Paul Ryan of their disappointment over the lack of a DACA amnesty.
